Family Educational Rights and Privacy Act (FERPA)
Dear Parents,
The Family Educational Rights and Privacy Act (FERPA) and district policy JR require the district to notify parents of their rights under FERPA. These rights include:
- The right of the parent or an eligible student to inspect and review the student’s education records.
- The intent of the district to limit the disclosure of personally identifiable information contained in a student’s educational record except, with the prior consent of the parent or eligible student or under certain circumstances as permitted by FERPA, the USA Patriot Act, or Every Student Succeeds Act (ESSA)
- The right of the parent or eligible student to seek to correct parts of the school education records that the parent or student thinks is inaccurate, misleading, or in violation of student’s rights.
- The right of the parent or eligible student to file a complaint with the ES Department of Educations if they believe the District has violated FERPA.
The district’s directory information policy/regulation required by the Family Education Rights and Privacy Act allows the district to designate certain pieces of information about students that, when disclosed, are determined to be harmless. If you exercise your right to opt-out, you should be aware that this will preclude the district from sharing any of your student’s information with other parties outside the district. In addition, your student’s information will be omitted from district publications including musical performances or athletic programs, honor roll listings, and other school celebrations. Your student’s information will also be omitted with third parties who legally request this information such as yearbook publishers. Opting out of the district’s directory information does not prevent students from participating in testing or other legally mandated activities.
The district’s policy and regulation honor our community’s need for information privacy. A copy of the policy and revised regulation can be accessed at http://policy.azsba.org/asba/Z2Browser2.html?showset=forthuachuca
The district has limited directory information to only the student’s name, photograph, grade level, school sports participation, and honors or awards received. Parents are to advise the principal, in writing, of any or all items listed above as directory information that they do not wish to have published or shared about their student. These letters should be submitted within the first two weeks of school or upon enrollment. Parents can modify their preferences at any time in a letter to the principal.
Respectfully,
Mark Goodman, Superintendent
